Pension Inheritance Tax 2027: What It Means If You Live Abroad

Moving to Kuala Lumpur, Singapore or Dubai will not keep your UK pension out of UK inheritance tax. From 6 April 2027, unused pension funds and most pension death benefits count towards your estate, and a scheme set up in the UK stays UK property wherever you live. The rule is already law. This post explains what changes, why the “wait out ten years abroad” idea does not work for a UK pension, who pays the bill when you die, and what the countries you live in charge on top. It is written for expats who hold a SIPP, a workplace pot or a final salary pension in the UK.

Key Takeaways

  • Yes. From 6 April 2027, a UK-established pension counts towards your UK estate even if you have left the UK, because the law treats it as property situated in the UK.
  • The measure is enacted. Finance Act 2026 received Royal Assent on 18 March 2026 and applies to deaths on or after 6 April 2027.
  • The 3 to 10 year “tail” after you leave mainly affects assets held outside the UK. It does not remove a UK pension from the estate.
  • Malaysia, Singapore, Thailand and the UAE have no inheritance tax treaty with the UK, so no treaty overrides the UK charge.

What Changes for UK Pensions on 6 April 2027?

From 6 April 2027, the value of your unused pension funds and most lump sum death benefits is added to your estate for inheritance tax when you die. Until then, most pensions sat outside the estate entirely.

Section 66 of the Finance Act 2026 inserts a new section 150A into the Inheritance Tax Act 1984, and sections 67 to 71 cover who pays and when the rules start. Section 150A treats you as owning your pension immediately before death. The law calls this “notional pension property”. The date that matters is the date of death, not the date the scheme pays out.

What gets counted depends on the type of pension:

  • For a SIPP or other defined contribution pot, it is the money in the pot that can be used to pay death benefits.
  • For a final salary (defined benefit) scheme, it is the lump sum death benefit, and any scheme continuation payment, that the scheme must pay or can reasonably be expected to pay.

The standard rate is 40%, charged only on the part of the estate above your available nil-rate bands. The nil-rate band is £325,000 and the residence nil-rate band is £175,000. The Finance Act 2026 extended the freeze on both to the 2030-31 tax year.

What Is Left Out?

Some benefits sit outside the new charge. A dependants’ scheme pension from a final salary scheme is excluded. So is death in service cover paid because you were working for that employer when you died.

The death in service exclusion is narrower than many people assume. HMRC’s technical note says payments from schemes “related to previous jobs that the deceased was a deferred member of, do not meet the conditions for this exclusion.” If you left a UK employer in 2015 and moved to Singapore, any lump sum from that old scheme is in scope.

What About Your Spouse?

The spouse and civil partner exemption extends to pension property your spouse receives under the scheme. Separately, the existing law caps the spouse exemption at £325,000 when you are a long-term UK resident and your spouse is not. HMRC’s two technical notes do not address how that cap applies to pension property, so a couple in that position should have it checked.

Does Leaving the UK Take Your Pension Out of UK Inheritance Tax?

No, not for a pension set up in the UK. The law treats it as situated where the scheme is established, and UK property stays in scope whatever your residence status.

Since 6 April 2025, inheritance tax has worked on residence instead of domicile. You are a “long-term UK resident” if you were UK resident for at least 10 of the previous 20 tax years. Long-term residents pay inheritance tax on their worldwide assets. Everyone else pays it only on UK assets.

The new section 150A(5) settles where a pension sits: “notional pension property in relation to a pension scheme is regarded as situated in the country or territory in which the scheme is established.” A SIPP run by a UK provider, or a final salary scheme from a UK employer, is therefore a UK asset.

HMRC’s technical note on inheritance tax and pensions puts it plainly. For people who are not long-term UK residents, inheritance tax “arises on any notional pension property held in a registered pension scheme… that is established in the UK.” Pension schemes established outside the UK drop out of the charge once you stop being a long-term resident.

How Long Does the Tail Last After You Leave?

The tail is the period after you leave during which you are still treated as a long-term UK resident. It runs from 3 to 10 tax years, depending on how long you lived in the UK. The rules are in section 6A of the Inheritance Tax Act 1984.

UK resident years (in the 20 years before leaving)Tail after you leave
13 or fewer3 tax years
144 tax years
155 tax years
177 tax years
2010 tax years

Each extra year of UK residence adds one year to the tail. A split year on arrival or departure counts as a full UK year for this test.

What Does the Tail Change for an Expat?

The tail decides when your non-UK assets leave the UK estate. Take a British engineer who lived in the UK for all 20 years before moving to Kuala Lumpur in 2024. For 10 tax years, a condo in Mont Kiara and an investment account held in Singapore stay in scope. After that, both drop out. The UK SIPP stays in scope throughout, because it is a UK asset.

How Much Could Your Family Pay?

If your whole estate is a £600,000 SIPP left to adult children, and no nil-rate band has gone on earlier gifts, the bill on a death on or after 6 April 2027 would be £110,000.

Here is the arithmetic. The first £325,000 falls within the nil-rate band. The remaining £275,000 is taxed at 40%, which is £110,000. The residence nil-rate band only applies to a home passing to direct descendants, so a SIPP alone does not use it.

The bill can grow if you die at 75 or over. In that case, most lump sums are taxed as pension income of the person who receives them, at their marginal rate. A new section of the income tax rules gives the beneficiary a deduction for the inheritance tax already paid on the same money. HMRC’s note says the portion “corresponding to the Inheritance Tax (and interest) paid does not count towards the beneficiary’s taxable income.”

If you die under 75, lump sums paid within two years of the scheme learning of the death, and within your remaining lump sum and death benefit allowance, are free of income tax. The standard allowance is £1,073,100.

Who Pays the Bill, and How Fast?

Your personal representatives pay the inheritance tax on your pension, and it falls due six months after the end of the month in which you die. Interest runs on late payment after that.

This creates a practical problem for families abroad. The executors of a will made in Malaysia may have no direct control over a UK pension. The law gives them two tools:

  • A withholding notice tells the scheme to hold back up to 50% of what each beneficiary is due, for up to 15 months after the end of the month of death.
  • A payment notice makes the scheme pay the tax to HMRC within 35 days, for amounts of £1,000 or more.

Beneficiaries share the risk too. Once pension money vests in them, they become jointly and severally liable with the personal representatives for the tax on it. If your daughter in Dubai receives your pension and the tax is unpaid, HMRC can pursue her.

HMRC says guidance for personal representatives will follow, and it promises interactive tools by April 2027. Its second technical note, published 27 August 2026, assumes all parties are long-term UK residents. Worked examples for non-residents are still to come.

What Do Malaysia, Singapore, Thailand and the UAE Charge?

None of these four countries has an inheritance tax treaty with the UK, so the UK charge applies in full. What each country charges on top differs.

MalaysiaEstate duty laws repealed with effect from 1 November 1991Finance Act 1992 (Act 476)
SingaporeEstate duty removed for deaths on and after 15 February 2008IRAS
ThailandHeirs pay 5% or 10% on the amount above THB 100 million received from one personInheritance Tax Act B.E. 2558
UAEGovernment tax page says “The UAE does not levy income tax on individuals” and does not mention inheritance taxu.ae

The UK’s inheritance tax treaties cover only a short list of countries, including Ireland, South Africa, the USA, the Netherlands, Sweden and Switzerland. Where no treaty exists, the UK gives credit for tax another country charges on assets located there. A UK pension is a UK asset, so that credit is unlikely to help with the pension itself.

Thailand needs care. Its tax falls on the heir. It reaches non-Thai heirs who are domiciled in Thailand under immigration law, and any non-Thai heir who receives assets located in Thailand. If your children live in Bangkok and stand to inherit more than THB 100 million, have a Thai tax specialist check their position.

What Should You Review Before April 2027?

Start with three documents: your pension nomination forms, your will, and a list of where each asset is established. Each one changes what your family pays and how quickly they can pay it.

Your nomination forms tell the scheme who you want to receive the money. A pension left to a spouse or civil partner can use the spouse exemption. A pension left to a charity can use the charity exemption.

Your will decides who acts as personal representative. If that person lives in Singapore and the pension is in the UK, check they can deal with HMRC and the scheme within six months.

The asset list matters because the tail treats UK and non-UK assets differently. Our guide to UK inheritance tax for expats in Malaysia covers the wider estate. If you are reviewing where your investments are held, see why we use Irish-domiciled UCITS over US ETFs for globally mobile clients.

This post is general information. A UK-regulated adviser or tax specialist should confirm your own position before you change anything.

Frequently Asked Questions

Is the April 2027 pension inheritance tax change confirmed?

Yes. The Finance Act 2026 received Royal Assent on 18 March 2026. Sections 66 to 71 bring unused pension funds and most death benefits into inheritance tax for deaths on or after 6 April 2027. HMRC is still publishing technical notes, and its guidance for personal representatives is not final yet.

Does my UK pension escape inheritance tax if I have lived abroad for more than 10 years?

No. A pension established in the UK is treated as a UK asset, and UK assets are in scope whatever your residence status. Ten years abroad ends long-term UK residence, which takes non-UK assets out of the estate. It does not remove a UK-established SIPP or final salary scheme.

Is my final salary pension subject to inheritance tax from 2027?

Partly. The lump sum death benefit a final salary scheme pays is counted. A dependants’ scheme pension, such as a spouse’s pension paid for life, is excluded. Death in service cover from your current employer is also excluded. Cover from a former employer’s scheme is not. See our guide to final salary pensions for expats in Singapore for how DB schemes work abroad.

Who pays inheritance tax on a pension if my executor lives overseas?

Your personal representatives are liable, wherever they live. They can issue a withholding notice capping payouts at 50% for up to 15 months, or a payment notice making the scheme pay HMRC within 35 days. Beneficiaries who receive the money also become jointly liable for the tax on it.

Does Malaysia or Singapore charge inheritance tax on top?

Malaysia repealed its estate duty laws with effect from 1 November 1991. Singapore removed estate duty for deaths on and after 15 February 2008. Neither has an inheritance tax treaty with the UK. Our guide to Malaysia’s tax on foreign income covers the income side.

Will my children pay income tax as well as inheritance tax on my pension?

If you die at 75 or over, most lump sums are taxed as their pension income at their marginal rate. They get a deduction for the inheritance tax already paid on the same money. If you die under 75, lump sums paid within two years of the scheme learning of the death, and within the £1,073,100 allowance, are free of income tax.
